We and our partners use cookies and similar technologies (web beacons, pixels, mobile SDKs) to operate the Services, remember preferences, prevent fraud, analyze traffic, and personalize content/ads. The Services may link to third‑party sites/apps (e.g., Zoom, Instagram, TikTok). We are not responsible for their content or privacy practices. Review their policies before providing data.

Terms of Service

IMPORTANT—ARBITRATION NOTICE & CLASS ACTION WAIVER: Except where prohibited by law, disputes will be resolved by binding arbitration on an individual basis. See Section 18.

These Terms of Service ("Terms") govern your access to and use of the Sites, Apps (including ElevateHER), Community, courses, events, journals and merchandise, and other Services provided by Maniscripting LLC (collectively, the "Services"). By accessing or using the Services, you agree to these Terms.

1. Eligibility & Accounts

You must be at least 18 (or the age of majority in your jurisdiction) to use the Services. Create an account with accurate information and keep your credentials secure. You are responsible for activity under your account.

2. Changes to the Services & Terms

We may modify the Services and these Terms at any time. If changes are material, we will provide notice (e.g., via email or in‑product). Continued use after changes become effective constitutes acceptance.

3. Community & Live Sessions

Our Community is a moderated space to support learning and connection.

Conduct: Be kind and respectful; no harassment, discrimination, hate speech, spam, or unlawful content. No pitching/soliciting (including DMs) without prior written permission.
Confidentiality: What’s shared in the Community should stay in the Community. Do not share screenshots without written permission.
Recordings: Live sessions (e.g., Zoom) may be recorded for replays. By attending, you consent to being recorded and grant us a license to use the recording as described in Section 9.
Enforcement: We may remove content or suspend/terminate access for violations, with or without notice.

4. Purchases, Subscriptions & Billing

Physical Goods (e.g., journals): Orders are subject to availability. Title and risk of loss pass upon delivery to the carrier. Taxes and shipping fees are shown at checkout. See our posted Shipping & Returns Policy (or your order confirmation) for details.
Digital Products & Memberships: Access may be one‑time, time‑limited, or subscription‑based. If you enroll in a subscription, it will auto‑renew at the then‑current price until canceled.
App Store Subscriptions: If you subscribed via Apple App Store or Google Play, manage/cancel through your app store account. We cannot cancel or refund app‑store purchases directly.
Trials & Promotions: At the end of a free trial, billing begins automatically unless canceled before the trial ends. Promotional pricing applies for the stated period only.
Cancellations & Refunds: Unless otherwise stated on a specific product page or order confirmation, digital products are non‑refundable. Physical goods returns are governed by the Shipping & Returns Policy. Certain high‑ticket programs may have separate agreements.

5. License & Access

Subject to these Terms, we grant you a limited, non‑exclusive, non‑transferable, revocable license to access and use the Services for personal, non‑commercial purposes. We reserve all rights not expressly granted.

6. User Content & Feedback

You may submit content (e.g., comments, posts, wins, images, audio, video, journal prompts) ("User Content"). You retain ownership of your User Content. You grant us a worldwide, royalty‑free, sublicensable license to host, store, reproduce, modify, create derivative works (e.g., formatting, transcripts), publicly display, perform, and distribute your User Content in connection with providing and improving the Services, including replays of live sessions. You represent you have all rights to grant this license and that your User Content complies with the law and these Terms.

7. Prohibited Uses

You agree not to:

Violate laws or infringe others’ rights;
Post or transmit unlawful, defamatory, harassing, hateful, or sexually explicit content;
Share others’ personal information without consent;
Upload malicious code or attempt to interfere with the Services;
Use scraping, data mining, or automated means without permission;
Misrepresent your identity, or attempt to access others’ accounts;
Reproduce, distribute, or exploit course content, downloads, or replays beyond personal use.

8. Intellectual Property

The Services, including content, design, trademarks, and technology, are owned by us or our licensors and are protected by IP laws. No rights are granted except as expressly set out in these Terms.

9. DMCA / Copyright Complaints

If you believe content infringes your copyright, send a notice to [email protected] with: (a) your contact info; (b) identification of the work; (c) identification of the allegedly infringing material; (d) a statement of good faith belief; (e) a statement under penalty of perjury that the information is accurate and you are authorized; and (f) your signature. We may remove content and terminate repeat infringers.

10. Health, Wellness, Financial & Results Disclaimer

We provide educational and informational content only. Nothing in the Services (including the Sites, Apps, Community, courses, events, audios, or products) constitutes medical, mental health, nutrition, fitness, legal, tax, investment, or other professional advice. No professional-client relationship (doctor–patient, therapist–client, advisor–client, fiduciary, etc.) is created by your use of the Services.

Health & Wellness. You should consult a physician or qualified health professional regarding any physical or mental health condition, exercise program, or lifestyle change. If you choose to participate in breathwork, movement, cold/heat exposure, or similar practices referenced in our content, you assume all risks. If you experience dizziness, pain, or adverse symptoms, stop immediately and seek medical attention. The Services are not a crisis resource; if you are in danger or experiencing a medical or mental health emergency, call your local emergency number (e.g., 911 in the U.S.).

Products & Alternative Modalities. Journals, crystals, sprays/mists, and similar items are intended for personal, spiritual, and educational use only. They are not intended to diagnose, treat, cure, or prevent any disease. Statements regarding such products have not been evaluated by the U.S. Food & Drug Administration (FDA). Discontinue use if irritation or adverse reaction occurs and consult a professional.

Financial, Earnings & Business. Content related to money, business, or career is for educational purposes and not financial, investment, legal, accounting, or tax advice. You should consult your own licensed professionals before making financial or business decisions. We do not promise, guarantee, or warrant any earnings, income, or specific business results. Any financial figures or case studies shared (including testimonials) are illustrative of what is possible and not typical; past results do not guarantee future outcomes.

Personal Responsibility. Your results depend on many factors outside our control, including your background, skills, effort, timing, market conditions, and health. You are solely responsible for your decisions and actions. To the fullest extent permitted by law, we disclaim liability for any loss, injury, or damages arising from your reliance on the Services.

11. Third‑Party Services

The Services may integrate with or link to third‑party services (e.g., Kajabi, Shopify, Zoom, app stores, payment processors, social platforms). We are not responsible for third‑party content or actions. Your use of third‑party services is governed by their terms and policies.

12. Termination

We may suspend or terminate your access for any violation of these Terms or for conduct that harms other users or the integrity of the Services. You may stop using the Services at any time. Sections that by their nature should survive (e.g., licenses, disclaimers, limitations, arbitration) will survive termination.

13. Disclaimer of Warranties

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Services will be uninterrupted, secure, or error‑free.

14. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Services. Our aggregate liability for any claim will not exceed the amount you paid to us for the Services in the 12 months preceding the event giving rise to the claim (or $100 if you have not paid us).

15. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms or applicable law.

16. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles, and applicable federal law.

17. Dispute Resolution; Arbitration; Class Action Waiver

Arbitration. Except where prohibited by law, any dispute arising from or relating to these Terms or the Services will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The seat of arbitration will be Travis County, Texas. The arbitrator may award relief only to the extent necessary to provide relief warranted by the claimant’s individual claims.

Class Action Waiver. You and we agree that any proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action.

Opt‑Out. You may opt out of arbitration within 30 days of accepting these Terms by emailing [email protected] with subject "Arbitration Opt‑Out" and your account details.

18. SMS Terms

By enrolling in SMS programs, you consent to receive autodialed marketing and transactional messages at the phone number you provide. Message and data rates may apply. Message frequency varies. Text STOP to cancel and HELP for help. Consent is not a condition of purchase.

19. Miscellaneous

These Terms constitute the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the remaining provisions will remain in full force. We may assign these Terms. You may not assign without our prior written consent. No waiver is implied by our failure to enforce any provision. Headings are for convenience only.
